Terms of Service

1. Operator and agreement

BuildersBids.com and the related marketplace services are operated by BuildersBids LLC (“BuildersBids,” “we,” “us,” or “our”). These Terms form a binding agreement between BuildersBids and the person and business using the service. A person acting for a company represents that the person is authorized to bind that company.

2. Eligibility and business use

Users must be at least 18 years old, capable of entering a binding agreement, and authorized to act for the registered business. BuildersBids is designed for legitimate construction-industry business activity, including General Contractors, Subcontractors, and approved Independent Sales Representatives. Account approval is not guaranteed.

3. Accounts, verification, and security

• Provide accurate, current, and complete account and company information.
• Complete email and company verification when required.
• Keep credentials confidential and use the account only for authorized purposes.
• Promptly report suspected unauthorized access, phishing, or credential compromise.
• Do not create duplicate, fictitious, misleading, or impersonating accounts.

BuildersBids may approve, reject, restrict, suspend, or request additional information for an account when reasonably necessary for safety, compliance, fraud prevention, verification, or marketplace integrity.

4. Marketplace role

BuildersBids provides technology for project posting, protected trade-specific access, bidding, communication, payment records, and related workflows. BuildersBids is not a General Contractor, Subcontractor, construction manager, architect, engineer, insurer, bonding company, employment agency, escrow holder, or guarantor of any user.

BuildersBids does not become a party to a construction contract merely because users meet, exchange information, purchase access, submit a bid, communicate, or accept a bid through the platform.

5. General Contractor responsibilities

General Contractors are responsible for:

• Having authority to post and distribute project information and files.
• Providing accurate project, location, trade, schedule, and contact information.
• Identifying revisions, addenda, deadlines, and material project changes.
• Reviewing bids and independently evaluating licensing, insurance, capacity, pricing, and qualifications.
• Complying with procurement, licensing, labor, privacy, and anti-discrimination laws.

6. Subcontractor responsibilities

Subcontractors are responsible for:

• Selecting only trades they are qualified, staffed, licensed, and prepared to perform.
• Reviewing plans, addenda, scope, measurements, site conditions, exclusions, and deadlines.
• Submitting accurate bids and identifying assumptions, alternates, exclusions, and expiration dates.
• Maintaining required licenses, registrations, insurance, bonding, permits, and tax compliance.
• Performing independent due diligence before contracting or beginning work.

7. Project files and restricted access

Project plans, specifications, addenda, contact details, proposals, and related records may be confidential or restricted. Access is limited to the authorized project and trade scope. Users may not redistribute, publish, resell, scrape, copy into another marketplace, or use restricted materials for an unrelated purpose.

Purchasing one trade does not authorize access to another trade. Contact information may remain protected until the applicable workflow authorizes disclosure, including acceptance of a bid where required.

8. Bids, communications, and awards

A bid submitted through BuildersBids is information from the bidding user; it is not reviewed, certified, guaranteed, or adopted by BuildersBids. A platform status such as submitted, accepted, rejected, pending, archived, or paid records the platform workflow and does not replace a complete construction contract.

Users must not use platform messaging to bypass paid access, disclose blocked contact information, harass another user, transmit malware, or make unlawful, deceptive, or discriminatory statements.

9. Fees and payment processing

Some BuildersBids services are free and others require one-time payment. Current products include a $49 General Contractor Limited 3-Bid upgrade per trade, $100 Standard Subcontractor trade access, and $125 Limited 3-Bid Subcontractor trade access. The price displayed in the applicable checkout controls if a price changes prospectively.

Payments are processed by Stripe. BuildersBids does not receive or store the complete card number or CVC. Access activates only after BuildersBids verifies successful payment. The Payment & Refund Policy is incorporated into these Terms.

10. Refunds, disputes, and chargebacks

Paid access is nonrefundable after it activates or is used. Duplicate charges, unauthorized charges, and verified technical failures that BuildersBids cannot correct may qualify for review. Users must contact BuildersBids promptly and provide the relevant checkout or payment reference. Filing a false chargeback or misrepresenting use of access may result in suspension and recovery of amounts lawfully owed.

11. User content and permission to operate the service

Users retain ownership of content they lawfully submit. Users grant BuildersBids a nonexclusive, worldwide, royalty-free license to host, reproduce, process, transmit, display, secure, back up, and use that content as reasonably necessary to operate, improve, protect, document, and enforce the service and the applicable project workflow.

Users represent that they have the rights and permissions needed to upload and share submitted content.

12. Intellectual property

BuildersBids and its licensors retain rights in the platform, software, databases, interface, branding, workflows, documentation, and original materials. No user may copy, reverse engineer, frame, mirror, resell, or create a confusingly similar service except as permitted by law or written authorization.

13. Prohibited conduct

The Acceptable Use Policy is incorporated into these Terms. Violations may result in content removal, access restriction, account suspension, termination, payment investigation, preservation of records, or referral to appropriate authorities.

14. Third-party services

BuildersBids may rely on hosting, email, payment, security, file-storage, and other service providers. Third-party services may have their own terms and privacy practices. BuildersBids is not responsible for an independent third party’s acts outside BuildersBids’ reasonable control.

15. Service changes and availability

BuildersBids may add, modify, suspend, or discontinue features and may perform maintenance. We do not promise uninterrupted or error-free service. When a confirmed payment completes but access is not finalized, users should not pay again and should contact support with the checkout reference.

16. Suspension and termination

BuildersBids may suspend or terminate access for suspected fraud, unauthorized disclosure, unlawful activity, security risk, nonpayment, abuse, misrepresentation, verification failure, repeated disputes, or a material violation of these Terms. Users may stop using the service at any time, but prior obligations and restrictions that should reasonably survive termination remain in effect.

17. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDERSBIDS IS PROVIDED “AS IS” AND “AS AVAILABLE.” BUILDERSBIDS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BUILDERSBIDS DOES NOT GUARANTEE PROJECT ACCURACY, CONTRACTOR QUALIFICATIONS, LICENSING, PAYMENT, BID AWARD, PROJECT COMPLETION, WORK QUALITY, SAFETY, OR BUSINESS RESULTS.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDERSBIDS LLC AND ITS OWNERS, AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, OR BUSINESS INTERRUPTION ARISING FROM THE SERVICE OR A USER-TO-USER TRANSACTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT THE CLAIMING USER PAID TO BUILDERSBIDS DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS ($100). THIS LIMIT DOES NOT APPLY WHERE LAW PROHIBITS IT.

19. Indemnification

To the extent permitted by law, a business user will defend, indemnify, and hold harmless BuildersBids LLC and its personnel from third-party claims, losses, liabilities, and reasonable costs arising from that user’s content, project, bid, construction activity, contract, legal violation, misuse of data, infringement, or breach of these Terms.

20. Governing law and venue

Except where controlling law requires otherwise, these Terms are governed by Nevada law without regard to conflict-of-law rules. Court proceedings arising from these Terms or the BuildersBids service must be brought in a state or federal court with jurisdiction in Clark County, Nevada. This does not prevent lawful temporary or emergency relief in another court with jurisdiction.

21. Changes and electronic communications

BuildersBids may update these Terms prospectively. Material changes will be identified by a revised effective date and may also be communicated through the website, account, or email. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law. Users agree to receive operational and transactional communications electronically.

22. Entire agreement and severability

These Terms, the Privacy Policy, Payment & Refund Policy, Acceptable Use Policy, Marketplace Disclaimer, and applicable written account or sales agreements form the agreement concerning the service. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law.
