Owner Marketplace Rules

Rules for Homeowners and Business / Property Owners who use BuildersBids to post construction, remodeling, repair, maintenance, or improvement opportunities.

1. These Rules Supplement the BuildersBids Terms

These Owner Marketplace Rules apply when a Homeowner, Business Owner, Property Owner, property manager, authorized representative, or other authorized user uses BuildersBids to request or seek construction-related services. These Rules supplement the BuildersBids Terms of Service and Privacy Policy. The Terms of Service remain the primary agreement governing use of BuildersBids.

2. Authority to Post a Project

By posting a project, you represent that you own the property, control the property, manage the property with appropriate authority, or otherwise have lawful authorization to request the work described. You may not post projects for property or work that you are not authorized to manage.

3. Accurate Project Information

You agree to provide information that is accurate and not intentionally misleading, including the project description, location information, photographs, plans, requested trades, timing information, and other material details you choose to submit. You should update material information if circumstances change.

4. BuildersBids Is a Marketplace Platform

BuildersBids provides technology and marketplace services that help Owners and independent construction professionals discover opportunities and communicate. BuildersBids is not the contractor performing your construction work and does not become a party to your construction contract solely because the parties met or communicated through BuildersBids.

5. Contractors Are Independent Businesses

General Contractors, Subcontractors, and other service providers using BuildersBids operate as independent businesses. Unless BuildersBids expressly states otherwise in a written agreement, they are not employees, agents, partners, or representatives of BuildersBids.

6. Contractor Selection and Due Diligence

You remain responsible for deciding whom to contact, interview, hire, or contract with. Before hiring a contractor, you should independently evaluate matters relevant to your project, including licensing, insurance, qualifications, references, scope, price, payment schedule, permits, warranties, and written contract terms.

7. Verification Is Not a Guarantee

BuildersBids may use verification, screening, documentation, or account-review procedures. Those procedures are intended to support marketplace security and quality. They are not a guarantee, warranty, endorsement, or promise that any contractor will remain licensed, insured, qualified, financially responsible, available, or suitable for a particular project.

8. No Guarantee of Bids or Project Results

BuildersBids does not guarantee that a project will receive a particular number of contractor responses, bids, proposals, or offers. BuildersBids also does not guarantee a particular price, schedule, workmanship level, permit result, inspection result, warranty, project completion date, or other construction outcome.

9. Your Construction Agreement Is With Your Contractor

Scope of work, pricing, deposits, progress payments, schedules, change orders, warranties, permits, inspections, materials, cancellations, and other construction terms should be addressed in the agreement between you and the contractor you select.

10. Privacy and Private Contact Information

BuildersBids does not publicly display your private contact information merely because you create an Owner account or post a project. Private information may include information such as your personal email address, telephone number, and exact street address.

Information may nevertheless be used or disclosed when reasonably necessary to operate the marketplace, provide requested services, facilitate authorized marketplace interactions, process transactions, prevent fraud or abuse, protect users or BuildersBids, work with service providers, comply with legal obligations, or as otherwise described in the BuildersBids Privacy Policy.

11. Project Information May Be Visible to Marketplace Users

Information intentionally included in a project posting may be made available to eligible marketplace participants as needed to present the opportunity. Depending on the project, this may include a general location, project description, requested trade, photographs, plans, specifications, timing, budget information, and other project details that you elect to provide.

Do not place sensitive personal information in project descriptions, photographs, plans, or other fields intended for marketplace viewing unless it is necessary and appropriate for the project.

12. Permits, Codes, and Legal Requirements

Owners and contractors are responsible for determining the permits, licenses, inspections, approvals, building-code requirements, association requirements, and other legal or regulatory obligations applicable to a particular project.

13. Prohibited Conduct

You may not use BuildersBids to submit fraudulent projects, impersonate another person or business, misrepresent your authority, distribute malware, harass users, unlawfully discriminate, obtain information for an unauthorized purpose, interfere with platform security, or engage in conduct prohibited by the BuildersBids Terms of Service or Acceptable Use Policy.

14. Independent Decisions and Disputes

Hiring decisions and construction transactions are made by the marketplace participants themselves. Responsibility for disputes relating to the contractor's work is governed by the applicable construction agreement, applicable law, and the BuildersBids Terms of Service.

15. Limitation Regarding Independent Marketplace Participants

To the maximum extent permitted by applicable law and subject to the BuildersBids Terms of Service, BuildersBids is not responsible for the independent acts or omissions of contractors, owners, or other marketplace participants. Nothing in these Rules is intended to waive rights or remedies that cannot lawfully be waived.

16. Electronic Acceptance and Records

When BuildersBids presents these Rules with an acceptance checkbox or similar electronic acceptance control, checking the box and completing the associated action indicates your agreement to the version presented to you. BuildersBids may retain evidence of acceptance, including policy version, account information, date and time, IP address, browser or device information, and related security records.

17. Updates to These Rules

BuildersBids may update these Rules as the marketplace evolves. When appropriate, BuildersBids may require users to accept an updated version before continuing certain marketplace activities.
